Lots of useful information out there for Nebraskans: http://www.neded.org/business/start-a-business As a sole proprietor you only register your trade name if you're doing business other than in your own name (E.g., "Lizzy T's" is not your own name, but could be a registered trade name). Sales taxes vary by location and type of goods; it is not a tax on the item but rather a tax on the transaction. You don't "take off" anything; the consumer pays you the taxes necessary and you forward them to the Dept of Revenue. You generally only collect taxes on retail sales of goods to people in your own state, but the NDOR has a detailed website on what's taxable, and at what rates and whether you need to have a tax-account with them. Trademark is not a verb. Please don't say things like "trademark my logo" or "trademarking it right now". It just tells people you've never done this before. If you register your TRADE NAME (business name), Nebraska law allows you to protect that from others trying to sell stuff using that name. State and federal laws also allow you to protect your TRADEMARK, which is a distinctive brand you put on your goods or the advertising for your services. You can optionally register a trademark, which costs $100 in Nebraska, or in the US Patent and Trademark Office (USPTO) for about $300. Non-registered trademarks can be enforced in state and federal courts, but registration is supposed to warn people that you're serious about your rights, so they don't even go there. You do, however, need to take the time to see if anyone else in your field (i.e., clothing) has already used any brand that would make yours "confusingly similar" and thus an infringement of their rights. Come on back when you have your business plan sketched out, with a budget, list of action items and so forth. There are lots of people here who can help steer you to the right places... Add: Kemperk has been into the eggnog. There is absolutely no legal obligation to be 18, or to have any "adult", let along "relative" involved, in order for you to be "open for business" online or anywhere else.
