his charge is not a credit issue, his crime, he commited a fraud, by using a credit card that wasnt his. is your fraud a felony or a misdeameanor?

If it was a felony then you can not join. If it was a misdemeanor then you might have a chance. So which was it?

No you cannot. You will have a background check and the government is not going to be able to trust that you will do the right thing. You have already proven you cannot be trusted and you will do whatever you want even if you know it is wrong and will hurt other people.
