It likely has a bad ESN, if someone reported it lost or stolen.

Not legally. It isn't yours. As soon as it is reported as stolen or lost, it will be blacklisted from obtaining cellular & data service. A cynic might think that someone asking your question in that manner was actually PLANNING to "find" one.

That is called "stealing" in every state of the union, and most other countries as well. The specific wording may differ, in my state it would be "theft by conversion", but it all means the same thing. You are a dirty rotten thief. Take it to a phone store at least, or to the police. Unless you really are a dirty rotten thief.

A found iPhone doesn't belong to you, so you cannot sell it. If you try to sell it and the actual owner tracks you down (which is possible with many modern phones), you can end up in prison. Any phone you find should be turned in to police.
