No, it would create a penalty.

Once you reach the pre tax max, the extra goes in as "post tax" rather than "pre tax". Its up to your employer to decide if he want to continue to fund you have the max. There is no penalty

What does your employment contract say? It will define whether or not the employer must continue to contribute to your retirement. No contract, then it is your employers decision to make and you have no say.
