You can legally file taxes as married, but it is not required. If you both work it would be better for you each to file separately and claim one child each. If you work and make less than 45000 dollars it would be better to file separately and you claim both children. There are many variables when it comes to taxes, see a professional. Not H&R block or one of those, go to an individual tax preparer. They will give you the best information.

This could be true depending upon the state in which you reside. Certain states allows this and some don't, check the laws within your state but if your state allows it than the IRS will honor your state laws. Goodluck
