Don't try to use the subjunctive 'be'. Your text will be more readable if you use 'are'. I found it amusing that you would strive for 'be' yet use such a vile word as 'preconditions'. The normal word 'conditions' is more than adequate to the task. And I am not sure what is meant by 'in regard to them.' Perhaps you mean this: "Both the man and the woman have the right to divorce if they meet certain conditions."?
