It shouldn't but people in charge and most of the people living in CA seem to be a few condoms short of a weekend bender.

Did you get a police report to show who was at fault? You're saying it was the other party's fault so their insurance company needs to pay up.

Who was declared at fault? If it was your family member the accident will indeed be reflected on your vehicle insurance policy. You would be then subject to a insurance rate increase. Your personal driving record will no way be effected because you were not the driver. If the family member was not at fault either your driving record or insurance coverage will be at jeopardy.
