This hasn't changed under ACA. Before ACA, when the person with medicaid died, some things could be taken at that time, after the person died. This has not changed. Before ACA, if the person was married, then the home could not be taken if either the husband or the wife was living in the home, even if one of them died. In other words, it could only be taken if both of them either died or moved. This has not changed. In short, it's not really an ACA issue. It's a medicaid issue, and a very old medicaid issue, which was nothing to do with the ACA, except that with the expansion of medicaid, there is a marginal increase in the number of affected individuals.
