Health insurance is regulated by each state. There is no law that requires insurers to offer mental health benefits. That would be going a bit far in regulating a private enterprise.

No. Obamacare does require that for a new policy to be "compliant", it must include mental health benefits - but old policies and noncompliant policies are still in existence, which do NOT include mental health benefits.
