It has nothing to do with price. I would have to see a picture, have a report to tell me which parts were damaged before I could even give a intelligent response. Those numbers with that year car suggests the worse, though.

So they see 3800 already and surely will find 200-400 more when they start working on it, so that would really put the bill at the private seller value of the car. Should be totaled.

If your car is only worth $4200 retail, and there's $3600 worth of damage, then more than likely, it will be a total. Of course, if you only had liability coverage on your car, then you'll get NOTHING from YOUR insurance company. If the other guy didn't have insurance, then you MAY be out of luck all round.

Yes. If those numbers are accurate then the car is definitely a total loss. You will have the option to keep the vehicle but the settlement will be reduced by the amount the vehicle is worth in it's wrecked condition (Salvage value).
