So long as the employees know what it is, it seems little different to a security camera.

Ethical, NO, Legal yes as long as it isn't the restroom or a place where employees do things like adjust their clothing, or expose body parts. If you want to be Ethical, get rid of the employees you don't trust and hire some that are trustworthy. Easier on everyone.
