Have you legally established his paternity in some way? If not, then no. You need to have established that he is the father. It might be that this is a good time to file for child support. Even if he dodges it, having a record that you filed will establish paternity. At that point, it depends on a number of situations. If the dad is unmarried and has no other children, unless there is a will, your child would inherit.

Its very complicated: 1) If you have paternity established then they will get Social Security if not then No! 2) Because you were never married you would NOT get survivors benefits! You can in some cases get paternity established by a DNA test done on his mother and father and your children! You have to go to court I do believe and get it ordered unless they are willing to go and do it but it is very expensive! Look into it!

No. Federal law states that in order to collect benefits, you must have been legally married for 10 years, upon which you and the children would be able to collect his benefits. Unless their father took out life insurance with either you or the children as benefactors, you will not be able to collect benefits.

If you have children with a man who didn't love you enough to marry you than the results is your going to have a hard time getting child support and if he's dead it's going to be even harder. What were you thinking when you let a man get you pregnate who wasn't intrested in marrying you. I guess your children will be the ones who pay the price for having irresponsible foolish parents . In the eyes of the law, if you are not married and have a child, the biological father isn't recognized as the father at all.... not until a DNA/paternity test is conducted (through the courts, usually) I wonder why you haven't done this?
