Magic has some of both. Basically, Magic has a variety of formats, from Standard, which includes only cards printed in the sets from the last 1-2 years (and older versions of any of those cards), all the way to Vintage and Legacy, which include every set ever printed except for the two joke sets (Unglued and Unhinged). Each format can also have its own ban/restricted list, though the fewer cards are in the format, the less cards show up on the banned. Standard is the format used for the vast majority of the officially sanctioned games, and is generally so finely tuned that most of the time it does not have any cards restricted or banned from the legal sets.
