Why are YOU not claiming them? This is not your issue, nothing to do with you. The only option you have is to file for the years in question and claim them, IRS will investigate to see whose claim is legal.

You don't need income to file. You can file, even if you don't have income. If you want to do something, then you can file, without income, and you can claim your kids, yourself, without income, when you file, without income.
