Answer #3 | 22/12 2013 11:43
Yes, as you remain dismissed until your appeal goes through...Quite honestly, if the post has already been advertised they think they were justified in dismissing you...and they don't think you'll win the case.

Answer #4 | 22/12 2013 11:44
Yes because they have already decided to sack you, they are just going through the motions of an appeal for legal reasons. They have no further interest in you. You have very cleverly NOT given us the reason for your dismissal because you know that what you did was quite serious and that is why you were dismissed.

Answer #8 | 22/12 2013 12:17
right now, it is NOT your job, so yes, they can advertise it. Even if you still held the job and they were THINKING about replacing you, they can advertise it. If you win the case, you will receive CASH COMPENSATION, not your job back, but unless your job was contractual, meaning you have a WRITTEN CONTRACT spelling out employment terms, you have an "at will" employment, and they can terminate you AT ANY TIME, FOR ANY REASON, or even no reason.

Answer #9 | 22/12 2013 12:30
Yes, because you have been dismissed and any appeal you might have, has probably been already seen as failing but off course they legally have to give you the opportunity to appeal the decision to dismiss you UK

Answer #10 | 22/12 2013 12:33
Yes. If you win the appeal and are offered reinstatement, they will simply stop the recruitment process.

Of course they can.

Answer #12 | 23/12 2013 10:59
They can but it's not really a smart move as it tends to show what they think the outcome of your appeal is going to be and it will bias the people hearing your case

Answer #13 | 23/12 2013 05:56
Off course they can. It is NOT "your" job. It may well have been a job you were employed to do but it is not YOURS.
